Sales conditions

PIXLEMON is an e-commerce website for the online sale of signs and direction signs and safety, for indoors and outdoors, obligation signs, prohibition signs, and danger signs

PIXLEMON sells its products online in Italy and abroad to consumers with no VAT registration number and companies with VAT registration number. Consumers and companies are thereafter called "Customers".

The current General Sale Conditions are applicable in the following countries: Austria, Belgium, Danmark (excluding the Faroe Islands, Greenland), Estonia, Finland (excluding Åland), France (excluding the oversea territories), Germany (excluding the island of Helgoland and the city of Büsingen), Greece, Ireland, Italy (excluding Campione d'Italia, the municipality of Livigno and Lago Lugano, Vatican City and San marino), Luxembourg, Malta, Netherlands, Poland, Portugal (excluding Açores and Madeira), the United Kingdom (excluding the Channel Islands, the Isle of Man and Gibraltar), Republic of Cyprus (excluding the Turkish Republic of Northern Cyprus), Czech Republic, Romania, Slovakia, Slovenia, Spain (excluding the Canary Islands and the cities of Ceuta and Melilla), Sweden, Switzerland, Hungary.


1. THE ONLINE CATALOGUE

Every product of the online catalogue is presented by a color image. The image serves as a mere indication, as colors and materials can vary slightly when viewing them on the screen.

Every product comes with a technical data sheet ("Product detail") illustrating its features, dimensions, materials and any other useful information.

Prices, technical details, aesthetic features can be amended at any time. Where possible, amendments will be indicated on the website www.pixlemon.com. It is recommended to verify prices and technical data sheets before completing the purchasing procedure.

PIXLEMON has stored 2,500,000 signs. This guarantees the possibility of dispatching most of the orders in 24/72 hours. Should the product not be available immediately, the order will be dispatched in 8/10 working days (excluding Saturdays, Sunday and Bank Holidays).

2. WAYS TO PURCHASE OUR PRODUCTS

The ways illustrated below can be updated or amended in any moment by PIXLEMON. Amendments will be indicated in the home page of the website www.pixlemon.com.

2.1. FILL THE ORDER FORM AND THE CART

Select the "cart" and follow the simple purchasing procedure, by selecting products and quantities.

2.2. CHECK THE AVAILABILITY OF PRODUCTS

immediate check of availability of products is not guaranteed on Saturday, Sunday and on Bank Holidays, in such days the dispatch site is not updated.

Also, it might happened that two orders made at the same time might not allow a prompt update of the availability.

2.3. CALCULATE THE TOTAL AMOUNT

Sales prices are expressed in EUR and do not include VAT, unless otherwise indicated. Prices may vary at any time. Before completing the order and making the payment, it is recommended to check the consistency of prices for the products in the cart. Only by activating the payment procedure on can be certain of the price fixed in the cart. Anyway, PIXLEMON checks prices and products ordered and has the faculty to block an order by informing the customer of possible issues that have been detected. Shipping costs vary according to the country of destination.

2.4. SUBMIT YOUR DATA

If you are a registered customer, you will be asked for your username and password. If you are not registered, you will have to fill a form with your personal data or your company data necessary for the registration.

By filling and sending the order form, the customer authorizes PIXLEMON to pass non-sensitive data (address / company address, telephone number) to the forwarder taking care of the shipment. The customer also authorizes PIXLEMON to use his/her/its contact details for any sort of communication related to the dispatch of the order.

2.5. COMPLETE YOUR PURCHASE

The purchase is completed by confirming it and by paying the total amount. In order to conclude the purchasing procedure it is necessary to read and accept the current Sale conditions.

2.6. MAKE A PAYMENT

It is possible to pay in two ways.

By means of PAYPAL, credit card or PayPal account. The payment procedure occurs in a connection established over a secure channel and it is managed directly by PayPal. PIXLEMON cannot access the Customer data in any way. By means of this payment procedure, the Customer authorizes PayPal to debit his/her/its credit card or PayPal account, the total amount of the online purchase and credit it to PIXLEMON.

2.7. PRINT INVOICE

The invoice is saved as a pdf file in the Customer account, where it can be accessed at any time.

3. DISPATCH OF THE ORDER AND DELIVERY

3.1. DELIVERY

The products ordered are delivered by the forwarder GLS.

3.2. PACKAGING

Products are individually packed and supplied with a bar code.

3.3. ORDER LEAD TIME

The order is dispatch and the items are delivered to the forwarder within 24/72 hour (excluding Saturdays, Sunday and Bank Holidays) upon reception of the payment.

In the exceptional circumstance, products are not available immediately, the order will be dispatched in 8/10 working days (excluding Saturdays, Sunday and Bank Holidays).

3.4. LEAD TIME AND SHIPMENT TRACKING

Generally our forwarder delivers in a matter of 24/72 hours (excluding Saturday, Sunday and Bank Holidays) and they can vary according to the country of destination; on the website www.pixlemon.com and on the website of the forwarder www.gls-italy.com, it is possible to track the dispatch process and check the date of delivery.

Further information
By the delivery date, we mean the date of the first delivery attempt from the forwarder, even if the attempt is not successful because the consignee is not in or refuses the goods. The delivery point is meant has to be the main entrance of the building and not the entrance of the household. A delivery delay cannot justify a refund request from the Customer.

4. RIGHTS AND DUTIES OF THE CUSTOMER AND THE SUPPLIER

4.1. GUARANTEE AND RESPONSIBILITY

PIXLEMON guarantees his products have no material or production faults. The products are manufactured using premium-quality materials, production systems and highly accurate printing devices, accurate packaging systems. PIXLEMON guarantees that the product sent corresponds exactly to the one indicated by “Products details”; it is flawless (no scratches nor dents) and the print is clear and readable, complete with every detail.

Should the Customer acknowledge some material or manufacturing faults upon reception of the goods (dents, scratches, incomplete prints), and it is clear that such damages are not due to the transportation, the Customer has the right to have a replacement or a refund within 8 days from reception of the goods. To find out how, please check 4.7. (Complaints and returned goods). For damages that can be attributed to transportation: please see 4.3. (Damages, losses or delays that can be attributed to the forwarder).

Damages caused by incorrect or bad use are not covered by the guaranty. PIXLEMON is not responsible for direct and indirect damages deriving from such uses. Consequently the Customer has to verify that the product is suitable to the use he/she /it intends to make of it, the Customer will take responsibility and risk deriving from the use he/she/it intends to make of the product.

4.2. TERMINATION

PIXLEMON has the right to refuse an order, by informing the client and returning the amount paid, if the payment has been made.

4.3. DAMAGES, LOSSES OR DELAYS THAT CAN BE ATTRIBUTED TO THE FORWARDER

In these cases, the Customer will have act directly and exclusively on the forwarder. PIXLEMON is waived from any responsibility since the goods are handed over to the forwarder.

4.4. TRANSMISSION OF DATA THAT DO NOT CORRESPOND TO THE TRUTH

It is prohibited to the Customer to tape untrue data into the registration form. Personal data or the company name, addresses, emails, telephone numbers have to correspond to the real ones; they cannot belong to third parties. The Customer commits to supply upon possible request of PIXLEMON, a copy of documents to prove the truthfulness of the data supplied.

4.5. FRAUDULENT USE OF PAYMENTS

PIXLEMON is not responsible the possible fraudulent and illicit use that can be made by third parties, of credit cards and other payment means when purchasing products, as it is not directly involved in any moment in the procedure.

4.6. THE RIGHT OF TERMINATION (valid for consumers)

The Customer has the right to terminate the contract stipulated, for any reason he/she is not satisfied of the purchase made, with no penalty and without having to explain the reason, within 8 days from receiving the goods. The termination will have to be communicated via email and followed by a letter sent via registered mail (if you fail to do so, your claims will be considered void). All the products will have to be returned in the same conditions they were at the time of reception, unused and intact, provided with the original wraps. Without these conditions, the termination right will be declared void. Costs for the return of the products and the risks for the transportation will be on the Customer. Once the integrity of the products that have been returned has been verified, PIXLEMON will credit the amount to the Customer, by returning the payment made with PayPal or a bank transfer. (As per regulation: article 64/67 of the Decree 206/2005)

4.7. COMPLAINTS AND RETURNED GOODS

Complaints must be presented within seven days from the reception of goods. A delay in the delivery or in the dispatch does not grant the Customer the faculty to refuse the goods or ask for compensation.

The possible return of the goods to PIXLEMON must be agreed and accepted in writing by PIXLEMON, beforehand. Costs for the return of the products and the transportation risks will be on the customer.

If the products are acknowledged to present lack of conformity, once they are checked, PIXLEMON will agree with the Customer to replace the products or to refund the Customer for the products value.

PIXLEMON has the right to debit the Customer possible charges paid to check the returned products and for their shipment, should they be intact and not presenting the lack of conformity declared bu the Customer.

4.8. FORCE MAJEURE

In any case of force majeure or extended strike, PIXLEMON cannot be held responsible for the delay or a missed delivery and it reserves the right to terminate the contract completely or partly, or to postpone the dispatch of the order.

4.9. PROCESSING OF DATA

Personal or company data are collected in order to register the Customer and activate the procedures to execute the order and to have the relevant comunication. Data are treated electronically complying with the regulations in force (Decree 196/2003); data will be communicated only to parties in charge of the execution of the order and delivery of the goods; they will not be transmitted to third parties.

The Customer will be able to amend his/her/its data at any time; moreover he/she/it can ask for the deletion in writing to the e-mail address: info@pixlemon.com.

The holder responsible for the collection and processing of personal data is Pixlemon Srl – via Fusana 1, Roncade 31056 – TV – Italy.

4.10. RELEVANT JURISDICTION

The Court of Treviso (Italy) shall have exclusive jurisdiction over any dispute.
